Department of Labor Releases Final Rule Defining Employees vs. Independent Contractors

In January 2024, the U.S. Department of Labor (DOL) released a final rule that will revise the federal framework for determining whether a worker is an employee or an independent contractor.


The new standard, which became law on March 11, 2024, is important because the Fair Labor Standards Act’s (FSLA) minimum wage and overtime pay protections do not apply to independent contractors, and many observers expect the new rule to result in significantly more workers being classified as employees rather than independent contractors

 

Corporate Transparency Act Overturned by Federal Court – Reporting Requirement Paused Until Appeals Court Hears Case

Members were recently alerted about a new Federal Regulation – known as the Corporate Transparency Act – requiring businesses with 20 full-time employees or those businesses with less than $5 million in sales to report any and all individuals who could be (or are considered) beneficial owners of the organization to the US Department of Treasury and its Financial Crimes Enforcement Network (FinCEN).
